How to Pass an Unethical Test Is to Do the Best With What's Given
𝗘𝘃𝗲𝗿 𝗴𝗲𝘁 𝗮𝘀𝗸𝗲𝗱 𝘁𝗼 𝗺𝗮𝗸𝗲 𝗱𝗲𝗰𝗶𝘀𝗶𝗼𝗻𝘀 𝘄𝗶𝘁𝗵 𝗶𝗻𝗰𝗼𝗺𝗽𝗹𝗲𝘁𝗲 𝗶𝗻𝗳𝗼?
I was sent 𝟰 𝙢𝙚𝙖𝙨𝙡𝙮 𝙥𝙖𝙜𝙚𝙨 and asked to opine.
Little did I know I was being tested
Medical malpractice case reviews take a long time
Because the medical records are voluminous
But you still have to comb through them all
𝙎𝙞𝙣𝙘𝙚 𝙨𝙢𝙖𝙡𝙡 𝙙𝙚𝙩𝙖𝙞𝙡𝙨 𝙢𝙖𝙠𝙚 𝙖 𝙗𝙞𝙜 𝙙𝙞𝙛𝙛𝙚𝙧𝙚𝙣𝙘𝙚
A plaintiff's attorney asked me to review a matter
So after scheduling a free litigation consultation
Where the case was discussed broadly
I then ruled out a conflict of interest
𝘼𝙣𝙙 𝙬𝙖𝙨 𝙥𝙧𝙤𝙢𝙥𝙩𝙡𝙮 𝙨𝙚𝙣𝙩 𝟰 𝙥𝙖𝙜𝙚𝙨
Why was this a shocker❓
Because I am usually sent thousands of pages
𝘼𝙣𝙙 𝙚𝙫𝙚𝙣 𝙬𝙤𝙧𝙨𝙚, 𝙩𝙝𝙚 𝙥𝙖𝙜𝙚𝙨 𝙬𝙚𝙧𝙚 𝙥𝙖𝙧𝙩𝙞𝙖𝙡𝙡𝙮 𝙧𝙚𝙙𝙖𝙘𝙩𝙚𝙙
I was sent:
• The Pre-operative eval (1 page)
• The Surgical operative report (2 pages)
• The Intra-operative paper record (1 page)
Sometimes you work with what you have
During the follow-up Zoom, I laid out my theory
I shared my screen and went line by line
Point by point, and gave a final answer
The attorney responded: "You're hired"

Turns out, I was being tested and I "passed" the test
The encounter still feels odd and makes me wonder
